Exception to Subdivision Platting for 30A Real Estate LLC (Precinct 2)

1) The Court finds that:
a.) 30A Real Estate LLC has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is Lot 93A Skrabanek 154.307 acre tract, Henry Austin Survey No. 4, Abstract 12, Brazoria County, Texas, and conveyed to 30A Real Estate LLC in County Clerk’s File Nos. 2023-051771; and
c.) The 10 acre tract is to be divided into 4 tracts along County Road 209: Tract 93A1 with 2.5 acres and approximately 161.31 feet of frontage along CR 209, Tract 93A2 with 2.5 acres and approximately 161.36 feet of frontage along CR 209, Tract 93A3 with 2.5 acres and approximately 161.26 feet of frontage along CR 209, and Tract 93A4 with 2.5 acres and approximately 161.25 feet of frontage along CR 209; and
d.) The Brazoria County Environmental Health Department has provided a letter dated January 25, 2024 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #8. Drainage District #8 has provided a letter dated January 11, 2024 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by 30A Real Estate LLC is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small
subdivision of 30A Real Estate LLC tract be granted. This exception is granted upon the following conditions:
a.) The applicant must record the survey in the Official Public Records of Brazoria County, Texas within 90 days from the approval by Commissioners Court or this court order is void, said document setting forth the allowable division and to be approved by the County Engineer; and
b.) Any further division of any of the affected lots must conform to the Brazoria County Subdivision Regulations; and
c.) No building permits will be issued for development on said tracts unless the Brazoria County Environmental Health Department has approved the proposed development.
3) It is ordered that a certified copy of this court order be recorded in the Official
Public Records of Brazoria County at the expense of the applicant.
