Exception to Subdivision Platting for Gabriel Loya, Joel Castillo and Maria I. Salazar (Precinct 4)

1) The Court finds that:

a.)                     Gabriel Loya, Joel Castillo and Maria I. Salazar has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and

b.)                     The property to be divided is 10.21 acres of land out of a 94.649 acre tract of land in the Day Land and Cattle Company Survey, Abstract 449 as recorded in Volume 2569, Page 1365 of the deed records of Fort Bend County, Texas and in the C. Longley Survey, Abstract 739 as recorded in County Clerk File No. 93035478, Brazoria County, Texas and being part of a called 144.9 acre tract of land recorded in Volume 210, Page 557 of the Fort Bend County deed records, and conveyed to Gabriel Loya, Joel Castillo and Maria I. Salazar in County Clerk’s File No. 2022-005329; and

c.)                     The 10.21 acre tract is to be divided into two tracts along County Road 12: Tract 1 with 5.1034 acres and approximately 152.35 feet of frontage along CR 12, Tract 2 with 5.1068 acres and approximately 152.35 feet of frontage along CR 12; and

d.)                     The Brazoria County Environmental Health Department has provided a letter dated February 20, 2025, stating they have no objection to the proposed division, under certain conditions; and

e.)                     This tract of land is in Drainage District # 11. Drainage District # 11 has provided a letter dated November 04, 2024, stating they have no objection to the subdivision; and

f.)                     The small subdivision approval requested by Gabriel Loya, Joel Castillo and Maria I. Salazar is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and

g.)                      The applicant has submitted to the County Engineer a plat of survey

prepared by a Registered Professional Surveyor showing the proposed division.

2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Gabriel Loya, Joel Castillo and Maria I. Salazar tract be granted.  This exception is granted upon the following conditions:

                     a.)                     The applicant must record the survey in the Official Public Records of                      Brazoria County, Texas within 90 days from the approval by Commissioners

                     Court or this court order is void, said document setting forth the allowable division and to be approved by the County Engineer; and

                     b.)                     Any further division of any of the affected lots must conform to the Brazoria

                                          County Subdivision Regulations; and

                     c.)                     No building permits will be issued for development on said tracts unless the                      Brazoria County Environmental Health Department has approved the                      proposed development.

3) It is ordered that a certified copy of this court order be recorded in the Official Public Records of Brazoria County at the expense of the applicant.
