Exception to Subdivision Platting for David E. Mouton (Precinct 1)

1) The Court finds that:
a.) David E. Mouton has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a tract of land containing 12.5477 acres, being Tract 43 and part of 44 of the Pleasant Bayou Land Company Subdivision in the Stephen F. Austin 1-3/4 League Grant, Abstract 37, Brazoria County, Texas, being out of a 30.626 acre tract of land conveyed unto Carl C. Hall by deed recorded in Volume 1546, Page 196 of the Deed Records of Brazoria County, Texas and being a tract of land conveyed unto Lisa Hudgens Rosa as recorded under County Clerk’s File No. 2015-030200 of the Official Records of Brazoria County, Texas and being part of a tract of land conveyed unto Michael Doxey as recorded under County Clerk’s File No. 2017-062612 of the Official Records of Brazoria County, Texas and conveyed to David E. Mouton in County Clerk’s File Nos. 2017-050326, 2019-026944 and 2018-051397; and
c.) The 12.5477 acre tract is to be divided into 3 tracts along a Public ROW created by Vol. 277 Pg. 498, DRBCT and Vol. 543 Pg. 235, DRBCTC: Tract 1 with 4.08 acres and approximately 472 feet of frontage along a Public ROW created by Vol. 277 Pg. 498, DRBCT and Vol. 543 Pg. 235, DRBCTC, Tract 2 with 2.24 acres and approximately 196 feet of frontage along a Public ROW created by Vol. 277 Pg. 498, DRBCT and Vol. 543 Pg. 235, DRBCTC, Tract 3 with 5.11 acres and approximately 164 feet of frontage along a Public ROW created by Vol. 277 Pg. 498, DRBCT and Vol. 543 Pg. 235, DRBCTC; and
d.) The Brazoria County Environmental Health Department has provided a letter dated January 29, 2026 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District # 3. Drainage District # 3 has provided a letter dated October 14, 2025 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by David E. Mouton is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of David E. Mouton tract be granted. This exception is granted upon the following conditions:
a.) The applicant must record the survey in the Official Public Records of Brazoria County, Texas within 90 days from the approval by Commissioners Court or this court order is void, said document setting forth the allowable division and to be approved by the County Engineer; and
b.) Any further division of any of the affected lots must conform to the Brazoria County Subdivision Regulations; and
c.) No building permits will be issued for development on said tracts unless the Brazoria County Environmental Health Department has approved the proposed development.
3) It is ordered that a certified copy of this court order be recorded in the Official Public Records of Brazoria County at the expense of the applicant.
