Exception to Subdivision Platting for Brenda Stewart Gregurek (Precinct 4)

1) The Court finds that:
a.) Brenda Stewart Gregurek has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is an 8.22 acre tract (called 8.825 acres), being the South portion of the David Lee Logdson, et ux called 14.0972 acre tract as recorded in County Clerk's File No. 92-38948, Brazoria County, Texas, less and except the South 40.00 feet of said tract; being 0.41 acre, now located within the Right-of-Way of State Highway F.M. 522, being an 80.00 foot State Highway Right-of-Way, Brazoria County, Texas, and conveyed to Brenda Stewart Gregurek in County Clerk's File No. 2010-014904; and
c.) The 8.22 acre tract is to be divided into two tracts along State Highway F.M. 522: Tract 1 with 5.933 acres and approximately 147 feet of frontage along State Highway F. M. 522, Tract 2 with 2.892 acres and approximately 301 feet of frontage along State Highway F. M. 522; and
d.) The Brazoria County Environmental Health Department has provided a letter dated February 24, 2026 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District # 11. Drainage District # 11 has provided a letter dated February 4, 2026 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Brenda Stewart Gregurek is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Brenda Stewart Gregurek tract be granted. This exception is granted upon the following conditio...
