1) The Court finds that:
a.) Marshall E. Dickens has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a 154.52 acre tract situated in the S.F. Austin 114 League, Abstract No. 26, Brazoria County, Texas, being the same called 154.522 acre tract conveyed to Elizabeth Cole as described in File No. 1993-006415 of the Official Records of Brazoria County, Texas and conveyed to Marshall E. Dickens in County Clerk's File No. 2025-044721; and
c.) The 154.52 acre tract is to be divided into 3 tracts along County Road 809 and 1 tract along County Road 809 and County Road 505: Tract 1 with 11.414 acres and approximately 300.54 feet of frontage along CR 809, Tract 2 with 11.414 acres and approximately 300.18 feet of frontage along CR 809, Tract 3 with 11.414 acres and approximately 299.82 feet of frontage along CR 809, and Tract 4 with 120.281 acres and approximately 1,802.83 feet of frontage along CR 809 and approximately 2,407.64 feet of frontage along CR 505; and
d.) The Brazoria County Environmental Health Department has provided a letter dated June 4, 2026 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #11. Drainage District #11 has provided a letter dated June 12, 2026, stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Marshall E. Dickens is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
