Order Terminating Interlocal Agreement with City of West Columbia related to Regulations on the Permitting of Retail Food Stores and Food Service Establishments

WHEREAS, on July 27, 2010, Commissioners Court Order VIII.B.3.a. was approved terminating all interlocal agreements with cities with more than 40 establishments regulated under the Permitting of Retail Food Stores and Food Service Establishments. The effective date of this Order was October 1, 2010: and
WHEREAS, the City of West Columbia was notified that on August 5, 2021, there were 42 Retail Food Store and Food Service Establishment permits in the City limits; and
WHEAREAS, the number of retail food stores and food services establishments permits in the City of West Columbia reached 41 as of January 7, 2025, exceeding the limit of 40 set in 2010;
THEREFORE, effective April 8, 2025 the Court hereby terminates the interlocal agreement with the City of West Columbia regulating the Permitting of Retail Food Stores and Food Service Establishments.
It is hereby ordered that all retail food stores and food service establishment permits issued by the County will now expire on May 31, 2025, therefore allowing the City of West Columbia to begin their permitting process on June 1, 2025.
The Environmental Health Department is further ordered to continue inspections on existing permits until May 31, 2025. The Brazoria County Environmental Health Department Director is hereby ordered to prepare a courtesy letter to the City of West Columbia notifying of the termination of the interlocal agreement and provide the City with a copy of any existing permits by May 1, 2025.
Further Ordered that a copy of this order be sent to the Brazoria County Environmental Health Department.
