Exception to Subdivision Platting for Josselyne Fernanda Cespedes and Luis A. Cespedes (Precinct 1)

1) The Court finds that:
a.) Josselyne Fernanda Cespedes and Luis A. Cespedes has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a tract of land containing 4.96 acres, being all of Lot 367 of the Fairview Farms Coast Land Companies Subdivision, Stephen F. Austin Survey, Abstract 23, Brazoria County, Texas, according to the recorded plat in Volume 2, Page 25 of the Plat Records of Brazoria County, Texas, and conveyed to Josselyne Fernanda Cespedes and Luis A. Cespedes in County Clerk's File No. 2019-025452; and
c.) The 4.96 acre tract is to be divided into 2 tracts along County Road 212: Tract 367A with 2.168 acres and approximately 121.77 feet of frontage along CR 212, Tract 367B with 2.794 acres and approximately 60 feet of frontage along CR 212; and
d.) The Brazoria County Environmental Health Department has provided a letter dated June 21, 2024 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District # 1. Drainage District # 1 has provided a letter dated December 13, 2023 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Josselyne Fernanda Cespedes and Luis A. Cespedes is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Josselyne Fernanda Cespedes and Luis A. Cespedes tract be granted. This exception is granted upon the following conditions:
