Exception to Subdivision Platting for Veronica Cervantes (Precinct 4)

1) The Court finds that:
a.) Veronica Cervantes has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a 10.904 tract of land, known as Tract 4A6, in the Day Land and Cattle Co. Survey, Abstract 590, and being out of that certain 297.412 acres of land situated in Brazoria County, Texas, conveyed by deed dated November 16, 2015 from Ben Winebrenner and wife Theresa, to Brecole, Inc., recorded in Brazoria County Clerk's File No. 2015-053641, Brazoria County, Texas, and conveyed to Veronica Cervantes in County Clerk's File Nos. 2016-010996 and 2016-037163; and
c.) The 10.904 acre tract is to be divided into 2 tracts, one along County Road 21 and County Road 20: Tract 1 with 8.0035 acres and approximately 635.52 feet of frontage along CR 21 and approximately 540.91 feet of frontage along CR 20, Tract 2 with 2.900 acres and approximately 225.90 feet of frontage along CR 21; and
d.) The Brazoria County Environmental Health Department has provided a letter dated September 2, 2025 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #11. Drainage District #11 has provided a letter dated October 5, 2025 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Veronica Cervantes is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Veronica Cervantes tract be granted. This exception is granted upon the following conditions:
