Exception to Subdivision Platting for Jesus Rodriquez (Precinct 4)

1) The Court finds that:
a.) Jesus Rodriquez has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a 33.89 acre (called 33.87 acre), tract situated in the S.M. Williams League, Abstract No. 139, Brazoria County, Texas and being all the same called 33.87 acre tract conveyed to Dorothy B. Moore recorded in Volume 1039, Page 411 of the Deed Records of Brazoria County, Texas and conveyed to Jesus Rodriquez in County Clerk's File Nos. 2012-025196 and 2012-025197; and
c.) The 18.87 acre tract is to be divided into 4 tracts; 2 along County Road 376 and 2 along State Highway F.M. 1301: Tract 1 with 7.69 acres and approximately 668.14 feet of frontage along State Highway F.M. 1301, Tract 2 with 5.20 acres and approximately 398.33 feet of frontage along State Highway F.M. 1301, Tract 3 with 3.00 acres and approximately 287.95 feet of frontage along CR 376, and Tract 4 with 3.00 acres and approximately 214.01 feet of frontage along CR 376; and
d.) The Brazoria County Environmental Health Department has provided a letter dated September 4, 2025 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #11. Drainage District #11 has provided a letter dated July 18, 2025 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Jesus Rodriquez is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
