Exception to Subdivision Platting for Sandra Garber (Precinct 1)

1) The Court finds that:
a.) Sandra Garber has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a 20.00 acre tract of land situated in the L. F. Tumlinson Survey, Abstract 374, Brazoria County, Texas, being the same called 20.00 acre tract of land conveyed to Richard C. Rennison recorded in County Clerk's File No. 2001-041996 of the Official Records of Brazoria County, Texas, being out of Lot 2, of the George E. Parker Subdivision, according to the map or plat thereof as recorded in Volume 95, Page 489 of the Deed Records of Brazoria County, Texas, and conveyed to Sandra Garber in County Clerk's File No. 2020-037188; and
c.) The 20.00 acre tract is to be divided into two tracts along County Road 203, Tract 1 with 6.1650 acres and approximately 200 feet of frontage along CR 203, Tract 2 with 13.8373 acres and approximately 448.90 feet of frontage along CR 203; and
d.) The Brazoria County Environmental Health Department has provided a letter dated November 21, 2024 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #5. Drainage District #5 has provided a letter dated October 10, 2024 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Sandra Garber is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Sandra Garber tract be granted. This exception is granted upon the following conditions:
