Section 115 Post-Employment Benefit Trust

The Court hereby adopts the attached Amended and Restated Brazoria County Section 115 Post-Employment Benefits Trust (the “Trust”), which is thereby effective this day, May 26, 2026;
The County, as Plan Administrator, hereby reaffirms Court Order H.36 dated August 26, 2025 delegating the administrative duties of the Trust, as they pertain to the Plan Administrator, to the Human Resources Director or her designee. The Human Resources Director is authorized to sign necessary documents to effectuate the duties of the Plan Administrator as set forth in the Trust.
The Court, in their authority as the Section 115 Post-Employment Benefits Trust Risk Pool Trustees, hereby appoint Texas Gulf Bank, N. A. as the interim Section 115 Trustee until such time as the service is procured pursuant to the County Purchasing Act, Local Government Code 262, et seq., or otherwise obtained. The County Judge is hereby authorized to execute a Trust and Custodial Agreement with Texas Gulf Bank, N. A. upon final review by the District Attorney’s Office.
The Court, in their authority as the Section 115 Post-Employment Benefits Trust Risk Pool Trustees, hereby remove the joint temporary Investment Managers of the Section 115 Trust appointed in Court Order H.38 dated August 26, 2025.
The County Judge, Risk Pool Trustees and the Human Resources Director are hereby authorized to execute documents relating to the establishment of and the administration of the Section 115 Post-Employment Benefits Trust upon final review by the District Attorney’s Office.
Further, a copy of this Order be provided to the Human Resources Director.
