Exception to Subdivision Platting for Dakota Schmidt (Precinct 4)

1) The Court finds that:
a.) Dakota Schmidt has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is All that certain 8.303 acres of land being that same called 8.303 acre tract conveyed to Barbara Jean Martin et al in County Clerk's File 2024-017508 of the Brazoria County Official Records and being that same tract described in Volume 1687, Page 230 of the Brazoria County Deed Records and out of Lot 12 of the Hallie Bowers Subdivision recorded in Volume 2, Page 175 of the Brazoria County Plat Records and being situated in the Stephen F. Austin 7-1/3 Leagues, Abstract 20, Brazoria County, Texas, and conveyed to Dakota Schmidt in County Clerk's File No. 2026-008543; and
c.) The 8.303 acre tract is to be divided into 4 tracts along County Road 345: Tract 1 with 1.00 acres and approximately 262.70 feet of frontage along CR 345, Tract 2 with 1.00 acres and approximately 262.70 feet of frontage along CR 345, Tract 3 with 5.30 acres and approximately 1392.20 feet of frontage along CR 345, and Tract 4 with 1.00 acres and approximately 253.76 feet of frontage along CR 345 and approximately 167.08 feet of frontage along CR 353; and
d.) The Brazoria County Environmental Health Department has provided a letter dated June 17, 2026 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #11. Drainage District #11 has provided a letter dated June 8, 2026 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Dakota Schmidt is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Su...
