1) The Court finds that:
a.) MVL Construction and Land Clearing, LLC has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is All that certain 5.00 acres of land out of the R.S. Stanger, Sr. called one hundred fifty acre tract being shown on the Tax Rolls as tract No. 12A-1D and said 5.00 acre tract being the same tract conveyed to George S. Usrey, as described in Volume 1294, Page 386 of the Deed Records of Brazoria County Texas, and conveyed to MVL Construction and Land Clearing, LLC in County Clerk's File No. 2026-000468; and
c.) The 5 acre tract is to be divided into 3 tracts; 1 tract along County Road 347 and 2 tracts along County Road 851A: Tract 1 with 3.006 acres and approximately 242.13 feet of frontage along CR 347, Tract 2 with 1.000 acres and approximately 121.02 feet of frontage along CR 851A, and Tract 3 with 1.000 acres and approximately 121.02 feet of frontage along CR 851A; and
d.) The Brazoria County Environmental Health Department has provided a letter dated June 17, 2026, stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #11. Drainage District #11 has provided a letter dated June 5, 2026, stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by MVL Construction and Land Clearing, LLC is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
