Whereas, the Court finds that the requisites of Texas Transportation Code 251.051 - Closing, Vacating and Abandoning Public Road - have been met in regards to a portion of a Public Road and its right-of-way identified in Volume 2, Page 81 in the Plat Records of Brazoria County, within the H. T. & B. Railroad Company Survey, Abstract 291; and
Whereas, a ~46.31-acre-parcel out of the H. T. & B. Railroad Company Survey, Abstract Brazoria County Clerk's Records, as recorded in Volume 2, Page 81 of the Plat Records of Brazoria County, and a ~26.3-acre-parcel out of the H. T. & B. Railroad Company Survey, Abstract 291, in Brazoria County, Texas, County Clerk's Document Nos. 2024-046753, 2005-039091, and 2005-039090 of the Brazoria County Clerk's Records, as recorded in Volume 2, Page 81 as are currently divided by certain public rights-of-way; and
Whereas, KB Home Lone Star, Inc. and KL LB BUY 5 LLC, the current owners of the tracts of land that abut said public rights-of-way, in the H. T. & B. Railroad Company Survey, Abstract 291, Brazoria County, Texas being that certain ~46.31-acre-parcel recorded in County Clerk's Document No. 2020-010166, and that certain ~26.3-acre-parcel recorded in County Clerk's Document Nos. 2024-046753, 2005-039091, and 2005-039090, according to map or plat thereof recorded in Volume 2, Page 81, Plat Records, Brazoria County, Texas; and
Whereas, each of the above owners has submitted written requests for the abandonment of the 40' rights-of-way located between the tracts; and Whereas, the 40' in width public rights-of-way are not being used for access to any adjoining properties; and
Whereas, a temporary public access easement must be filed in separate instrument within 30 days of this abandonment, else this order shall be null and void; and
