Prohibition of Outdoor Burning

The Court, under the authority of Local Government Code §352.081, makes a finding that circumstances in all or parts of the unincorporated areas of Brazoria County create a public safety hazard that would be made worse by outdoor burning. Because of the existence of a long-term deficit of moisture, an increase in occurrence of wildfires have occurred; therefore, the Commissioners Court has determined that outdoor burning will be prohibited or restricted for the next 90 days, the first effective day being January 27, 2026.

 

This Order does not prohibit outdoor burning activities related to public health and safety that are authorized by the Texas Commission on Environmental Quality for: (1) firefighter training: (2) a public utility or natural gas pipeline; (3) burns that are conducted by a prescribed burn manager certified under Section §153.048, Natural Resources Code, and meet the standards of Section §153.047, Natural Resources Code.

 

Further, the County Judge may rescind this order without further action from this Court, when the Keetch-Byram Drought Index reaches below 450 for five consecutive days.

 

Further, the County Judge or his designee, is authorized to issue press releases and public service announcements to inform the public of the prohibition on outdoor burning.
