Exception to Subdivision Platting for Frank P. Corder and Patricia Corder (Precinct 1)

1) The Court finds that:
a.) Frank P. Corder and Patricia Corder has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is a 16.092 acre tract of land out of a called 57.37 acre tract situated in the S. F. Austin 1-3/4 League Grant, Abstract 37, Brazoria County, Texas, being the same called 16.118 acre tract conveyed to Brenda M. Smith recorded in County Clerk's File No. 2011-033582 and previously conveyed to Larry D. Smith, M.D., according to the recorded plat in Volume 1354, Page 297 of the Plat Records of Brazoria County, Texas, and conveyed to Frank P. Corder and Patricia Corder in County Clerk's File No. 2012-057879; and
c.) The 16.12-acre tract is to be divided into 4 tracts along County Road 916: Tract 6B3B with 4.815 acres and approximately 441 feet of frontage along CR 916, Tract 6B3C with 4.815 acres and approximately 396 feet of frontage along CR 916, Tract 6B3D with 2.794 acres and approximately 717 feet of frontage along CR 916, and Tract 6B3A with 3.669 acres and approximately 528 feet of frontage along CR 915; and
d.) The Brazoria County Environmental Health Department has provided a letter dated June 19, 2024 stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #5. Drainage District #5 has provided a letter dated June 6, 2024 stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Frank P. Corder and Patricia Corder is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
