Cancellation of Economic Development Agreement between Brazoria County and Cradle Solar, LLC

Whereas, on August 24, 2021, through Court Order 6.Q.1, this Court approved an Economic Development Agreement between Brazoria County and Cradle Solar, LLC for the development of a solar-powered electric generating facility located in Brazoria County; and
Whereas, the terms of the Agreement were amended through Court Order Nos. 6.M.10, dated July 12, 2022, 7.C.1, dated July 26, 2022, and H.5, dated November 28, 2023; and
Whereas, Cradle Solar, LLC was to commence construction on or before December 31, 2024.
Whereas, Cradle Solar, LLC failed to commence construction of the project by the commencement date.
Whereas, on January 15, 2025, Brazoria County provided notice of intent to terminate in accordance with the Economic Development Agreement.
Therefore, the Court, through this Court Order, hereby terminates the Economic Development Agreement between Brazoria County and Cradle Solar, LLC effective February 21, 2025.
