Exception to Subdivision Platting for Stephen Ralph Lostracco, Mark Clinton Lostracco, Roy Craig Lostracco (Precinct 2)

1) The Court finds that:
a.) Stephen Ralph Lostracco, Mark Clinton Lostracco and Roy Craig Lostracco,
has requested approval for an exception from subdivision platting regulations for a small subdivision, by application attached; and
b.) The property to be divided is Lot 16, Bosler Subdivision, Joshua Abbott
League Survey, Abstract 144, Brazoria County, Texas, according to the recorded plat in Volume 1, Page 88 of the Plat Records of Brazoria County, Texas, and conveyed to Stephen Ralph Lostracco, Mark Clinton Lostracco and Roy Craig Lostracco in County Clerk's File Nos. 2023-028652; and
c.) The 80-acre tract is to be divided into 2 tracts along County Road 48: Lot 16A with 2.13 acres and approximately 343.50 feet of frontage along CR 48, Lot 16B with 77.87 acres and approximately 212.76 feet of frontage along CR 48, and
d.) The Brazoria County Environmental Health Department has provided a letter dated January 4, 2024, stating they have no objection to the proposed division, under certain conditions; and
e.) This tract of land is in Drainage District #5. Drainage District #5 has provided a letter dated December 5, 2024, stating they have no objection to the subdivision; and
f.) The small subdivision approval requested by Stephen Ralph Lostracco, Mark Clinton Lostracco and Roy Craig Lostracco, is in accordance with the criteria established in Brazoria County Subdivision Regulations Article 4, Section D, Pages 16-17; and
g.) The applicant has submitted to the County Engineer a plat of survey prepared by a Registered Professional Surveyor showing the proposed division.
2) It is therefore ordered that an exception for filing a plat of the division for small subdivision of Stephen Ralph Lostracco, Mark Clinton Lostracco and Roy Craig Lostracco, tract be granted. This exception is granted upon the following conditions:
